dc.description.abstractLívia Roberta, the consultant for this opinion, begins by discussing the sexual abuse she suffered several times during her childhood, around the age of eleven, at the hands of her uncle Sérgio ‘Lorota’. After years of silence and the development of countless emotional and psychological traumas, Lívia finally decided to file a complaint about everything she had experienced during her childhood. It so happened that after the police investigation was opened, Sérgio tried to escape, however, he was found a few days later, taken into preventive custody and subjected to interrogation, but without the presence of lawyers at the time. After the investigation process was concluded, the police chief forwarded the case to the Criminal Court and officially opened the criminal proceedings, considering the crime as defined in art. 217-A of the Penal Code.pt_BR
dc.description.resumoLívia Roberta, consulente deste parecer, inicia tratando a respeito do abuso sexual sofrido durante algumas vezes na infância, por volta dos seus onze anos, por seu tio Sérgio ‘Lorota’. Após anos de silêncio e o desenvolvimento de inúmeros traumas emocionais e psicológicos, Lívia por fim resolveu entrar com uma denúncia acerca de tudo o que havia passado na infância. Ocorre que após a instauração do inquérito policial, Sérgio tentou fugir, no entanto, foi encontrado após alguns dias, rendido à prisão preventiva e submetido a interrogatório só que sem a presença de advogados na ocasião. Findo o processo do inquérito, o delegado remeteu os autos à Vara Criminal e instaurou oficialmente o processo penal considerando-se o crime tipificado no art. 217-A do Código Penal.pt_BR
