dc.description.abstractFirst, it should be noted that the receipt of the infraction notice was signed by the applicant, a partner in the company, on March 15, 2023, suspending the deadline for filing a prior defense against the environmental infraction notice. Therefore, under the terms of art. 113 of Decree No. 6,514/2008, amended by Decree No. 11,373/2023, the deadline for filing a Prior Defense is 20 (twenty) business days, counted from the date of notice of the infraction, that is, the notification.pt_BR
dc.description.resumoPrimeiramente, há que se registrar que o recebimento do auto de infração foi assinado pelo requerente, sócio da empresa, em 15 de março de 2023, sobrestando o prazo para apresentação de defesa prévia contra o auto de infração ambiental. Portanto, nos termos do art. 113 do Decreto nº 6.514/2008, alterado pelo Decreto nº 11.373/2023, o prazo para a apresentação de Defesa Prévia é de 20 (vinte) dias úteis, contados a partir da data da ciência da autuação, ou seja, da notificação.pt_BR
