Diante de todo exposto conclui-se a priori que, Isabel não teria direito ao salário maternidade, mas estudando o caso com mais cuidado, entende-se que a mesma tem legitimidade para fazer jus ao benefício, já que ela mantém vinculo empregatício com Marcelo e o mesmo como empregador fica obrigado à recolher junto ao (RGPS) Regime de Previdência Social.
