dc.description.abstractThe initial claims made by the opposing party are permeated with obscurity, the contract is classified as having a commutative nature and of continued execution. The contracting parties were agreed upon a purchase and sale contract for an automobile, in the amount of R$100,000.00 (one hundred thousand reais), divided into 20 monthly installments of R$5,000.00 (five thousand reais). 17 (seventeen) installments were paid, leaving only 3 (three) installments unpaid. It is worth noting the tiny amount to be paid, in comparison to the penalty clause inserted in the contract, and the violation of the principle of good faith.pt_BR
dc.description.resumoOs pedidos iniciais feito pela parte adversa são permeados de obscuridade, o contrato é classificado tendo natureza comutativa e de execução continuada. Aos contraentes, foi pactuado um contrato de compra e venda, de um automóvel, no valor de R$ 100.000,00 (Cem mil reais), dividido em 20 parcelas mensais de R$ 5.000,00 (Cinco mil reais). Foram adimplidas 17 (dezessete) parcelas, restando apenas 3 (três) prestações inadimplidas, é de se destacar, o ínfimo montante a ser pago, em comparação a clausula penal inserida no contrato, e a violação ao princípio da boa-fé.pt_BR
