dc.description.abstractDiego and Ana, married under the universal community property regime, purchased José's automobile for R$100,000.00 (one hundred thousand reais). The formal purchase and sale agreement provided for this amount to be paid in 20 (twenty) monthly installments of R$5,000.00 (five thousand reais). However, the couple was unable to fully comply with the stipulated rule, since they were unable to pay the last 3 (three) installments of the agreement. For this reason, based on clause 13 (thirteen) of the aforementioned agreement, José filed a lawsuit against Diego and Ana, requesting the termination of the contract, the return of the property, the receipt of a fine of 70% (seventy percent) on the value of the installments not yet paid, and also the search and seizure of the vehicle.pt_BR
dc.description.resumoDiego e Ana, casados sob o regime da comunhão universal de bens, adquiriram o automóvel de José pelo montante de R$ 100.000,00 (cem mil reais). O contrato formal de compra e venda firmado previa que essa quantia fosse paga em 20 (vinte) parcelas deR$5.000,00 (cinco mil reais) mensais. Sucede que, o casal não conseguiu cumprir integralmente a norma estipulada, uma vez que não conseguiu quitar as 03 (três) últimas parcelas do acordo. Por essa razão, embasado na cláusula de número 13 (treze) do referido contrato, José entrou com uma ação judicial contra Diego e Ana, solicitando a rescisão contratual, a devolução do bem, o recebimento da multa de 70% (setenta por cento) sobre o valor das parcelas ainda não quitadas, e ainda a busca e apreensão do veículo.pt_BR
