dc.description.abstractThe Plaintiff lived for approximately six months in a stable union with Mr. PAULO NOBRE, a Brazilian, single, factory toolmaker. However, on August 2, 2023, as a result of a work accident, Paulo died, leaving the Plaintiff as his only dependent. This fact led the Plaintiff to contact the Defendant, claiming the Survivor's Pension Benefit, through a protocol with the Social Security Authority. However, on August 29, 2023, the Plaintiff was informed that her request, NB 123.456.789-0, had been denied. This denial is due to the argument that her condition as a dependent of the deceased was not demonstrated, since they had lived together for a period of less than two years, a fact that did not grant the Plaintiff the right to the survivor's pension.pt_BR
dc.description.resumoA Autora viveu, aproximadamente, seis meses em regime de união estável com o Sr. PAULO NOBRE, brasileiro, solteiro, ferramenteiro de fábrica. Ocorre que, em 02 de agosto de 2023, em decorrência de um acidente de trabalho, Paulo veio a óbito, deixando a Requerente como sua única dependente. Fato que levou a Autora a dirigir-se à Requerida, pleiteando ao Auxílio da Pensão por Morte, perante um protocolo junto à Autarquia Previdenciária. Todavia, na data de 29 de agosto de 2023, a Requerente foi informada que seu pedido, NB 123.456.789-0, fora negado. Tal negativa decorre do argumento de que não restou demonstrada a sua condição de dependente do falecido, visto que ambos viviam juntos há um período inferior a dois anos, fato que não deferiu o direito à pensão por morte à Autora.pt_BR
