dc.description.resumoCompetência da ação penal e progressão de regime. Demissão de funcionários que insistem em greve ilegal. Evicção. Tutela de urgência cautelar. A PETRA Mineradora S.A e a STEIN mineradora, que já esperavam pela queda no seu faturamento em decorrência da pausa da prestação de serviços pela empresa TRAE, foram à Justiça pleitear a suspensão do contrato formalizado entre as partes, e a devolução das quantias que entendiam pagas indevidamente. Em conclusão, portanto, nos parece acertada a decisão do Juízo, que concedeu fundamentadamente a tutela pleiteada pelas mineradoras. Se porventura o feito vier a ser julgado improcedente, a prestadora de serviços ré deverá demonstrar os prejuízos que decorreram da medida, e deverá por estes ser indenizada.pt_BR
