    This is a legal opinion formulated by Izadora Aparecida Moreira Baldassi, Jackeline Ferreira Cusentini and Mylena Simioni Santichiolli as a result of a question raised by the institution's collegiate board regarding the case described below: This lawsuit refers to a case that encompasses the corporate, constitutional, civil and criminal spheres of Brazilian law. Analyzing the case presented, it is clear that it involves a clothing manufacturing company, managed by Ernesto, theoretically the managing partner, who laid off his employees without paying the due labor benefits.

    Mathias, who had worked for 10 years at Costurarte, a casual clothing manufacturing company, was surprised on a normal workday, along with the other workers at the company, by the arrival of Ernesto, Costurarte's managing partner. Ernesto was visibly worried. Mathias and the other workers stopped their work and turned their attention to Ernesto, curious to know the reason for his presence. Ernesto, with a choked voice, informed the workers that the company would no longer be able to continue operating, and that they were free to look for other jobs. Furthermore, the company did not have the resources at that time to settle the severance payments, which would be done gradually, as the situation improved.
